Alors que dans son <a href=\"https:\/\/www.bger.ch\/ext\/eurospider\/live\/de\/php\/aza\/http\/index.php?highlight_docid=aza%3A%2F%2F01-03-2016-4A_465-2015&amp;lang=de&amp;type=show_document&amp;zoom=YES&amp;\" target=\"_blank\" rel=\"noopener noreferrer\">arr\u00eat 4A_465\/2015<\/a>, le Tribunal F\u00e9d\u00e9ral semblait inscrire dans la pierre sa jurisprudence constante sur le calcul de rendement, il a admis dans son dernier arr\u00eat, que le rendement de 0.5 point au-dessus de l\u2019int\u00e9r\u00eat hypoth\u00e9caire de r\u00e9f\u00e9rence ne se justifiait plus lorsque le taux publi\u00e9 par l\u2019Office f\u00e9d\u00e9ral de la statistique (OFS) est inf\u00e9rieur \u00e0 2%.<\/p>\n<p>Est d\u00e9sormais admissible, <strong>une marge de 2 points en sus du taux hypoth\u00e9caire de r\u00e9f\u00e9rence<\/strong>, lorsque ce dernier s\u2019\u00e9l\u00e8ve \u00e0 moins de 2%.<\/p>\n<p>Le Tribunal f\u00e9d\u00e9ral consid\u00e8re en outre que <strong>les fonds propres investis doivent dor\u00e9navant \u00eatre int\u00e9gralement revaloris\u00e9s selon l\u2019indice suisse des prix \u00e0 la consommation (IPC)<\/strong>, et ne limite plus cette r\u00e9\u00e9valuation \u00e0 seulement 40% de l\u2019indice comme c\u2019\u00e9tait le cas auparavant.<\/p>\n<p>Le Tribunal f\u00e9d\u00e9ral reconna\u00eet la baisse durable du taux hypoth\u00e9caire de r\u00e9f\u00e9rence comme un changement notable de circonstances, justifiant l\u2019\u00e9volution jurisprudentielle \u00e0 laquelle les bailleurs n\u2019osaient plus croire, apr\u00e8s tant d\u2019ann\u00e9es et de critiques.<\/p>\n<p>Il faut saluer le constat du Tribunal f\u00e9d\u00e9ral, qui prend acte du fait que les rendements permis jusqu\u2019ici avec des taux hypoth\u00e9caires inf\u00e9rieurs \u00e0 2%, \u00e9taient nettement insuffisants pour les propri\u00e9taires institutionnels. On pense en particulier aux caisses de pension et assureurs-vie, qui travaillent avec 100% de fonds propres et pour qui le paiement des rentes sur le long terme, n\u00e9cessite un rendement \u00ab\u00a0technique\u00a0\u00bb au-del\u00e0 de 3%, voire 4% dans certains cas.<\/p>\n<p>Enfin, cette \u00e9volution de jurisprudence et ses effets, ne vont pas sans rappeler l\u2019initiative populaire dite \u00ab\u00a0des loyers loyaux\u00a0\u00bb lanc\u00e9e dans les ann\u00e9es 90 par l\u2019ASLOCA et qui visait \u00e0 \u00ab\u00a0lisser\u00a0\u00bb le taux hypoth\u00e9caire de r\u00e9f\u00e9rence sur une p\u00e9riode de 5 ans. Cette initiative, \u00e2prement soutenue par les locataires en p\u00e9riode de forte hausse des taux, avait ensuite \u00e9t\u00e9 \u00ab\u00a0habilement\u00a0\u00bb oubli\u00e9e par les militants, lorsque les taux avaient subi une baisse notable et durable&#8230;<\/p>\n<p>GVA law vous assiste dans le cadre des contentieux immobiliers et institutionnels.
